We have introduced a new suite of configurations for Salaried Employment Agreements to allow the employers to manage the salaried employees, who are under Individual flexibility arrangements, directly within the award instead of having to remove them.

This introduction, which is an enhancement rather than a legislative update requirement, includes the items below if they do not already exist within an award:

  • Pay Categories (Salary and Salary - Public Holiday Not Worked).
  • Leave Allowance Templates for “No loading” and “With loading”.
  • Rule Set to disregard timesheets.
  • Pay Rate Templates.
  • Employment Agreements for all employee types (full-time, part-time, and casual).

For detailed information on the changes, please refer to our guide here.

We have also renamed all leave allowance templates by adding the award code as a prefix. This ensures each template can be accurately associated with its respective award, particularly in cases where template names are identical.

We have also updated the Rest Break rule to automatically apply a meal break after 5 hours worked.
If a shift should not have an auto meal break, please use the “Hours worked with no meal break” work type in the timesheet.

We’ve made the following changes to the award:

Updated Rules:

  • '27.3 Public holiday minimum engagement' rule has been updated to apply only to shifts.
    • It will no longer trigger for Leave Without Pay or Personal/Carer’s Leave.
    • A new work type, 'No minimum shift engagement', has been introduced for situations where an employee leaves work early.
  • '23.1 Pay span of hours overtime (FT/PT)' and '23.1 Pay span of hours overtime (Cas)' rules were updated to apply across the full shift period for Full-Time, Part-Time and Casual employees.
  • Rules relating to rest period after working overtime were updated to reflect clause 20.6 of the award, with the following changes:
    • A new work type, 'No rest period after overtime', has been introduced to align with clause 20.6(c), covering situations where an employee resumes work without the required 10 consecutive hours of rest following overtime.
    • The rules '23.8 Less than 10 hours between shifts (FT/PT)' and '23.8 Less than 10 hours between shifts for shiftworkers other than shift changes (FT/PT)' have been merged into a single rule, resulting in the removal of the latter.
    • In line with clause 20.6(c), which allows a reduced rest period of 8 hours (instead of 10) specifically for shift changes, the work type 'Shiftwork changes' has been renamed to 'No rest period after overtime – shiftwork changes' for greater clarity.
    • The rules have been updated to trigger payment during overtime in these situations, leading to the creation of the following pay categories, which have been enabled in the pay rate templates:
      • Permanent – Less than 10 hour break between shifts – overtime
      • Permanent – Less than 8 hour break between shifts – overtime
  • The rules for public holiday payments have been updated to ensure the correct application of public holiday overtime penalty rates. To support this, new pay categories have been created and enabled in the pay rate templates:
    • Casual – Public Holiday Overtime
    • Permanent – Public Holiday Overtime

New Rules:

New rules have been introduced for public holidays not worked to ensure accurate payment of both ordinary time and overtime, specifically:

  • 27 Public holiday not worked
  • 27 Apply overtime - public holiday not worked

Further information

Time in Lieu Explanation

Time off instead of payment for overtime leave accrues at the same rate as the number of overtime hours worked. For example, an employee who worked two overtime hours has an entitlement to two hours’ time off. If you do take time off for overtime and the time off you intend, pay it out, you must pay at the overtime rate applicable to the overtime when worked.

It also applies when you terminate an employee and you have to pay out the time. To pay it out correctly, you will need to record the overtime rate manually while you are processing the time in lieu accrual. We suggest that you record the overtime details in the Notes section of the leave accrual line in the pay run.

If you are required to pay out the time off for overtime either before or during termination, you can run a Pay Run Audit Report. It will show the pay runs for the employee where they accrued Time in Lieu, enabling yout to determine the applicable rates. Next, you can run an Employee Payment History Report to determine if they took any of the time off for overtime. You can then determine the correct balance based on the number of hours by taking the equivalent to the overtime payment that you made.
