We have updated the award with the following changes.

1) Rules have been reviewed and updated to ensure the proper application of these requirements:

  1. Minimum shift engagement
    • We have updated the rules to pay a minimum time for hours worked, unless when the work type "No Minimum Shift Engagement" is selected.
  2. Work during meal break
    • We have updated the rules to split the payments of double time between ordinary hours and overtime hours.
    • Employees need to submit the work type "No meal break" and work for more than 5 continuous hours without a break to trigger this payment.
  3. Rest periods after overtime without 10 consecutive hours
    • We have updated the rules to split the payments of double time between ordinary hours and overtime hours.
    • Employees need to submit the work type "Rest periods after overtime without 10 consecutive hours" and have a break of less than 10 hours before resuming work.
  4. Rest periods after overtime without 8 consecutive hours - Shiftworkers
    • We have updated the rules to split the payments of double time between ordinary hours and overtime hours.
    • Employees need to submit the work type "Rest periods after overtime without 8 consecutive hours" and have a break of less than 8 hours before resuming work.
  5. Afternoon shift
    • We have updated required ending time of afternoon shifts to after 7.00 pm and at or before midnight.
  6. Night shift
    • We have updated required ending time of night shifts to after midnight, and at or before 7.00 am.
  7. Permanent night shift
    • We have updated required ending time of permanent night shifts to after midnight, and at or before 7.00 am.

2) The penalty loadings have been reviewed and updated accordingly for below pay categories:

  • Casual - Public Holiday
  • Permanent - Overtime (Public Holiday)
  • Permanent - Public Holiday
  • Permanent - Saturday
  • Permanent Shiftwork - Permanent night shift
  • Permanent Shiftwork - Saturday, Sunday or Public Holiday

We have identified an issue affecting Paid Family and Domestic Violence Leave (PFDVL) accrual calculations. The accrual method was changed from "BASED ON A LEAVE YEAR" to "ON AN ONGOING BASIS," which may have caused incorrect leave accruals for some employees. The award has been updated to correct the accrual configuration.

We have updated the award with the following changes:

  1. We have updated all rule sets and implemented a new rule and respective new work type for Travel Time Allowance in accordance with clause 18.3(d)(iii).
  2. New rules have been added to all rule sets and respective new work types to allow the option of selecting work types to trigger the Laundry Allowance and First Aid Allowance.
  3. The Time Off Instead of Overtime rule has also been updated to ensure that the corresponding leave is accurately processed.
  4. In addition, we have removed the comma from the [19.2(c)] Shiftworker - Ordinary hours do not include Saturday Sunday or Public Holiday tag. This adjustment prevents the tag from splitting into multiple tags and ensures the rule is triggered correctly.
    NB: If this tag is currently in use, please ensure the award is updated and the tag is reassigned to the relevant employees.
  5. We have updated the default rule set period to be "weekly, ending Sunday". 
  6. We have updated all rule sets and added numerous rules to ensure all work scenarios would be paid correctly for Sunday and Public Holiday hours worked per clause 21.2(b).
    • When the shift starts and ends on the Sunday/Public Holiday (e.g. from 2:30pm to 11pm)
      • All hours are paid at Sunday/Public Holiday rate
        When the shift starts and ends on the Sunday.png
    • When the shift starts on the Sunday/Public Holiday (between 11pm and midnight) and extends into the next working day (e.g. 11:00pm-8am)

  • Where ordinary time is worked on a shift starting before midnight on the day before a Sunday or public holiday and extending into the Sunday or public holiday - the rate in clause 21.2(a) will apply to all time worked on that shift.

    • An employee’s ordinary hours do not include these days;
    • The work is not continuous with the starting or finishing time of their ordinary shift.

Recall to duty: 3 hours

Non-shiftworkers

  • Sunday - 4 hours, provided the employee is available to work for 4 hours;
  • Public holiday - 4 hours
    • Hours worked performed immediately before or after a part-day public holiday, that form part of one continuous shift, are counted as part of the minimum payment/engagement period.

    • Where a shift is worked by arrangement between the employees themselves.
Payment of annual leave.

Day workers:

  • 17.5% annual leave loading;

Shiftworkers:

  • 17.5% annual leave loading or the shift loading had the employee not been on leave, whichever is higher.

Special notes

15.2 Auto meal break

The platform can only accommodate a defined duration for unpaid breaks, either 30 minutes or 60 minutes. Award setup is that 30 minutes of break will be automatically deducted from the time if no break recorded

The platform can only accommodate a fixed number of hours worked for a break to be applied either after five hours or six hours. Award setup is that auto meal break will be deducted from the hours after 5hrs and 30mins. You can customise this rule.

16.4 Higher Duty

Please note that rules will not be able to interpret the duty of position due to platform limitations and will require manual intervention.

Work types

Work types are a description of the kind of shift you are working, and you select them when you record a timesheet. The following is a list of work types employees can select on their timesheet, and the meaning of each item.

A - F
Annual Leave Taken. Choose this work type when annual leave is taken
Compassionate Leave Taken. Choose this work type when compassionate leave is taken.
First Aid Allowance. Choose this work type if appointed to perform first aid duty.
G - L
Kilometre Allowance (motor car).  Choose this work type to record the number of kilometres an employee has travelled using their own vehicle in the performance of their duties.
Kilometre Allowance (motorcycle).  Choose this work type to record the number of kilometres an employee has travelled using their own motorcycle in the performance of their duties.
Laundry allowance. Choose this work type if the employee is required to wear and launder a uniform.
Leave Without Pay Taken. Choose this work type when any unpaid leave is taken.
Living away from home - travel time allowance. Choose this work type when payment at ordinary rates of pay for all time spent in travelling between the employee’s usual place of employment and the temporary location. 
Long Service Leave Taken. Choose this work type when any unpaid leave is taken.
M - R
Meal Allowance (first overtime allowance).  Choose this work type when an employee is required to work more than 1.5 hours of overtime after their ordinary end time without being provided 24 hours’ prior notice or works approved overtime for more than 5 hours on a Saturday or Sunday.
Meal Allowance (second overtime allowance).  Choose this work type when an employee's overtime worked exceeds 4 hours, or exceeds nine hours if worked on a Saturday or Sunday.
No meal break. 

Choose this work type when working during meal break.

No Minimum Shift Engagement Choose this work type when minimum shift engagement should not apply.
Paid Community Service Leave Taken. Choose this work type when community service leave is taken.

Shift Conditions are further details you can add to a shift where more than one condition applies to your shift. Shift conditions are selected when you edit a timesheet record, or when clocking on using the ClockMeIn Time and Attendance or Swag apps. The following is a list of Shift Conditions employees can select on their timesheet, and the meaning of each item.

M - R
No Minimum Shift Engagement Select this shift condition when minimum shift engagement should not apply.
Rest periods after overtime without 10 consecutive hours Select this shift condition when the end of one period of duty and the start of the next is less than 10 hours.
Rest periods after overtime without 8 consecutive hours Select this shift condition when the end of one period of duty and the start of the next is less than 8 hours.

Employee Tags are specific conditions typically related to the employee’s agreement. These are often conditions negotiated and agreed between the employer and the employee, or unique characteristics of the employee’s role. Payment of these provisions is usually of a recurring and ongoing nature.

First aid.

Assign this tag if an employee has an appropriate first aid qualification and is appointed first aid officer.

G - L
Laundry. Assign this tag if an employee is required to perform work determined by the leading hand or supervisor to be of a dirty nature.

Permanent Night Shift. Assign this tag if an employee is assigned on a permanent night shift which does not rotate with another shift or shifts or day work and which continues for a period of not less than 4 consecutive weeks.
S - Z
Shiftworker - Ordinary hours do not include Saturday Sunday or Public Holiday.

Assign this tag if a full-time or part-time shiftworker whose ordinary hours do not include a Saturday, Sunday or a public holiday.

Assign this tag to convert all overtime work hours into a Time in Lieu accrual.
